Finally it appears the update for the sound issues of this device will soon be addressed this morning via. an update. The update is to be stored on the HD-DVD drives internal memory as opposed to the Xbox 360 directly, to get the update it appears you have to put in an HD-DVD disc in your Xbox 360 HD-DVD Player and if the update is available you will be prompted to download it. This way seems to make sense as there is little point in forcing this update on every Xbox 360 owner, as obviously not everyone owns the device.

I just shoved King Kong in now and have got the update, can't test out the DD 5.1 or DTS yet as I have my optical cable connected to my PS3 (its a tight fit) and my system only has 1 optical input. But I can confirm the update has gone live and should Xbox 360 HD-DVD owners load up a HD-DVD disc they will be promted with an update, or at least I just was anyway.
